PATIENTACCESS PORTAL TERMS OF USE

INTRODUCTION


This web site ("Site") and all other matters and services therein are provided by Nova Southeastern University, Inc., ("NSU") to its patients subject to compliance with the terms and conditions set forth below. Please read the following information carefully. Your continued use of this Site is your agreement to be bound by the terms and conditions set forth below. If you do not agree to be bound by these terms and conditions, then you will not be granted access to “PatientAccess” and you should promptly exit this Site


PRIVACY


Your privacy is of the utmost importance to us. NSU will use your confidential health information in order to provide you health care services. NSU will, at all times, maintain your confidential health information in confidence. Please review the NSU Notice of Privacy Practices for a thorough description of how we gather, use, and protect your confidential health information. All messages sent and received within PatientAccess that contain health information are subject to Florida and federal laws governing the security and confidentiality of medical records.


SECURITY


COMMUNICATIONS


Communications through PatientAccess are not the only manner in which you may contact your health care provider. You may continue to use all means of communication that you have previously used unless you are notified that that communication means will terminate.


DO NOT USE PATIENTACCESS TO COMMUNICATE MEDICAL/DENTAL EMERGENCY OR URGENT HEALTH CARE ISSUES. IF THERE IS AN EMERGENCY, YOU SHOULD CALL 911 OR GO TO AN EMERGENCY ROOM.


All communications through PatientAccess will be over a secured connection You will received email from NSU that you have communications available in PatientAccess regarding your confidential health care information, but no confidential health care information will be contained in the communication. In order to review the communication, you will have to log in to PatientAccess to view the communication. You must keep email and contact information current to continue to receive communications from PatientAccess. Although there will not be any confidential health information in the email, others with access to your email account may view the email communications with NSU. You should use caution in allowing others access to your email account as the email notification may be something you do know want others to know.


All communications through PatientAccess will become part of your permanent health care record with NSU. Communications through PatientAccess will be handles by NSU in a manner similar to how other means of communication are handles. Although NSU strives to timely respond to communications in the PatientAccess, NSU cannot guarantee that your concerns will be addressed in any specific time period. If you do not receive a response within three (3) business days, you should phone your health care provider for further follow up. All follow up and appointments are your responsibility.


You must have a US based mobile or land line telephone number for call or SMS notifications.


ACCESS/PROXY ACCESS


ACCESS. Upon initial enrollment in PatientAccess, you will be required to create a username and password. It is extremely important to keep your username and password confidential. If anyone else has access to this information they will be able to log into your PatientAccess and view your confidential health care information. It is your responsibility to keep your username and password secure, prevent disclosure and make changes to your password if you believe that it has been compromised.


PROXY ACCESS. You may authorized others to access your confidential health care information by completing the Proxy Access to PatientAccess form and submitting it to NSU Medical Records Department https://nsuhealth.nova.edu/patient-information/health-records. The Proxy will remain in effect until it is terminated by you. You can limit the confidential health care information that your Proxy may access as directed in the Proxy Access to Patient Portal form. You may revoke the Proxy Access by completing the Revocation of Authorization for Proxy Access to Patient Portal form in the Patient Portal which will provide additional information.


RESTRICTED ACCESS. Under state and federal law, a minor patient under the age 18 may give consent for treatment of certain protected health conditions and restrict parental or legal representative access to such medical records. Because of these legal rights, parents will only be provided limited access to records on-line of a minor patient 12-17 years of age. However, a parent or legal representative may obtain a copy of their child’s health information that is not protected by such laws by contacting NSU https://nsuhealth.nova.edu/patient-information/health-records.


ACCURACY AND COMPLETENESS OF INFORMATION AND DISCLAIMER


Information contained in PatientAccess is provided “as is” without any warranty of any kind and is meant only to support your relationship with your current and future NSU health care providers. Although NSU and its provider attempt to ensure the integrity of this site they make no guarantees whatsoever as to the correctness or accuracy of the site. It is possible that the site could include typographical errors, inaccuracies, discrepancies or other errors.


Information that is included in your confidential health care information on PatientAccess may not be your complete medical record. Posting of confidential health care information is at the discretion of your NSU health care provider. If information is not available in PatientAccess, you should contact PatientAccess for copies of your medical records. In the event that an inaccuracy or discrepancy arises, you shall inform NSU so that it can be corrected. Information contained on this site may be changed or updated without notice.


Nothing in the PatientAccess is intended to be used for the purpose of medical diagnosis or treatment. The information posted in PatientAccess should not be considered complete nor should it be relied on to suggest a course of treatment for a particular individual. You should always seek the advice of your health care provider with any questions you may have regarding a medical condition, and you should never disregard medical advice or delay seeking medical advice because of something you read on PatientAccess. No treatment requests or diagnosis can be requested nor will be made via PatientAccess.


NSU and its providers take no responsibility for any disclaim any and all liability arising from how you use the information you obtain from PatientAccess and any restriction access PatientAccess for maintenance or matters beyond the control of NSU.


You agree not to hold NSU, its health care providers, trustees, officers, or employees liable for any loss, injury, or claims of any kind resulting from the use of PatientAccess or any messages you fail to read and comply with in a timely manner.


TERMINATION


NSU may restrict or terminate access to PatientAccess at any time and for any reason. Use of the system unrelated to the purpose of furthering your medical care may result in the suspension or termination of access privileges. Violations of these Terms of Use, improper activities and activities deemed to cause a disruption to clinic operations, the interpretation of which is within the sole determination of NSU, may result in termination of access.


You may terminate your account by contacting the NSU Dental Clinic.


AVAILABILITY OF PatientAccess


The PatientAccess may become unavailable due to system failures, back-up procedures, maintenance, or other causes beyond the control of NSU. Access is provided on an “as-is, as-available” basis and NSU do not guarantee that you will be able to access PatientAccess at any particular time. NSU take no responsibility for and disclaim any and all liability arising from inaccuracies or defects in software, communication lines, virtual private network, the internet or any internet service provider, access system, computer hardware or software, or any other service or device that you use to access PatientAccess. You further understand that NSU cannot be held responsible for (a) absolute security of all electronic communication transmissions between me and NSU; (b) unauthorized disclosure resulting from my failure to log out of an active session; (c) unauthorized disclosure resulting from someone other than you reading information printed by you from PatientAccess; (d) unauthorized disclosure resulting from personal computer settings or installed software products that may compromise information security; or € similar events outside the control of NSU

All pages within PatientAccess and any material made available for download are the property of NSU and contractors. PatientAccess is provided for patients and their designated proxies only. The words NSU, NSU Health and other references to NSU and their associated corporate logos are the trademarks and service marks of NSU. Nothing herein shall be construed to grant any license or right to use the corporate logos/ trademarks/ services marks without the prior written approval of NSU.
